 Arkansas Supreme Court Agrees with AARP, Ending Unconstitutional Payday Lending
AARP Foundation Litigation and AARP Arkansas, which leads a statewide coalition working to stop abusive payday lending, teamed up to successfully urge the Arkansas Supreme Court to strike down a state law that allows payday loans with interest rates above the state constitution’s limit.

 
 Maryland Court Protects Against Unwanted Institutionalization
AARP attorneys represent a Maryland woman fighting to stay out of a nursing home and obtain Medicaid home and community based services. The state’s top court ruled that the state used an overly restrictive reading of the law, and that the decisionmakers did not allow her to present all the evidence she should have been allowed to present – a tremendous precedent for older and disabled people seeking to avoid institutionalization.

 
 Employees Should Be Allowed to Go to Court to Fight Discrimination
Today, the U.S. Supreme Court hears arguments in an age discrimination case, 14 Penn Plaza v. Pyatt, that asks the Court to find that mandatory arbitration clauses in collective bargaining agreements can not limit an employee’s right to go to court to enforce federal rights.

 
 AARP Bulletin Survey on the Transition to Digital TV: Executive Summary
The AARP Bulletin commissioned a nationwide survey in September 2008 to find out whether adults ages 18+ are aware of the February 2009 transition from analog to digital broadcast television signals. The survey findings indicate that virtually all adults with TVs are aware of the upcoming transition, suggesting that public outreach efforts to inform TV owners of the impending change have been largely successful. Members were highly concerned about being misled or taken advantage of by companies selling products over the phone (78 percent) or the Internet (52 percent); they were most concerned about becoming a victim of identity theft. Today, the Supreme Court will be hearing oral arguments in Wyeth v. Levine on one of the most important issues facing it this Term -- a case in which AARP has urged the Court not to close courtroom doors on people harmed when drug manufacturers fail to provide adequate warnings about a drug’s risks.

 
 AARP Urges Court to Uphold Montana’s Efforts to Limit Arbitrariness in Disability Benefit Decisions
AARP has filed a “friend of the court” brief in the United States Court of Appeals for the Ninth Circuit supporting the State of Montana’s efforts prohibiting “deference clauses” when making eligibility determinations for insurance benefits. AARP argues that federal law does not preempt the state insurance law

 
 AARP Urges Supreme Court to Require Participants to Follow the Plan Terms in Order to Change Beneficiary Designations
AARP has filed a “friend of the court” brief in support of neither party in the Supreme Court case of Kennedy v. Plan Adm’r for DuPont Sav. & Inv. Plan. AARP argues that employee benefit plan documents establish who may be a beneficiary and, here, the executrix of the estate did not meet any of the plan criteria.

 
 AARP Asks Federal Appeals Court to Uphold ADA Claims
AARP Foundation Litigation attorneys filed AARP’s brief for workers challenging UPS policies limiting workers’ return to work from medical leave. AARP defended the workers’ right to band together to assert class action claims based on common grievances. An adverse ruling would set disability law apart from other civil rights laws, a result not intended by Congress in enacting the Americans with Disabilities Act (ADA).

 
 AARP Asks Court to Uphold Ruling Allowing Nursing Home Negligence Case to Proceed to Trial
AARP filed a “friend of the court” brief in a case alleging negligence by a nursing home operator.

 
 Court Upholds Enforcement of Family/Medical Leave Act
A federal appeals court agreed with AARP’s “friend of the court” brief and ruled in favor of a worker fired after she sought to invoke her statutorily-protected medical leave rights.
